In response to ongoing tensions surrounding Russia’s actions in Ukraine, the Council of the European Union has taken decisive steps to reinforce existing restrictive measures. Under the authority of the Treaty on the Functioning of the European Union, and specifically Article 215 thereof, the Council enacted Decision (CFSP) 2024/746 on 23rd February 2024. This decision amends the existing Decision 2014/512/CFSP concerning restrictive measures aimed at addressing Russia’s destabilizing actions in Ukraine.
The decision, formulated following a joint proposal from the High Representative of the Union for Foreign Affairs and Security Policy and the European Commission, reflects the European Union’s commitment to maintaining peace and stability in the region.
Key highlights of Decision (CFSP) 2024/746 include the addition of 27 new entities directly supporting Russia’s military and industrial complex in its aggressive actions against Ukraine. This expansion necessitates tighter export restrictions on dual-use goods, technology, and items that could contribute to the enhancement of Russia’s defense and security sector.
Furthermore, the decision extends controls to entities in third countries indirectly supporting Russia’s military endeavors, as well as certain Russian entities involved in the development, production, and supply of electronic components for military purposes.
Significantly, the decision broadens the list of controlled items, incorporating components essential for the development and production of unmanned aerial vehicles, reflecting evolving security concerns.
Moreover, Decision (CFSP) 2024/746 imposes additional restrictions on exports that enhance Russia’s industrial capabilities. Additionally, it extends import control measures on iron and steel to more partner countries, emphasizing the need for uniform application across all Member States.
These measures, falling within the scope of the Treaty on the Functioning of the European Union, underline the necessity for regulatory action at the Union level to ensure their consistent implementation across all Member States. Consequently, Regulation (EU) No 833/2014, which addresses restrictive measures related to Russia’s actions in Ukraine, is accordingly amended.
With these decisive actions, the European Union reaffirms its commitment to upholding peace and stability in the region, while sending a clear message regarding its stance on Russian aggression. The Regulation, effective upon its publication in the Official Journal of the European Union, binds all Member States, underlining the Union’s solidarity and determination in addressing challenges to regional security.
